The Roman Rota was judging an appeal in which a husband alleged invalidity of the marriage. Though the wife complained that his betrayal of marital fidelity were the cause of their separation (not invalidity)
At the First Instance Tribunal in 2002, the formula of the doubt was established:
First: To declare the nullity of the marriage between Beniamin and Brigida due to error concerning a quality of the wife, conjoined with deceit?
Second: To declare the nullity of this marriage on the grounds of the wife’s incapacity to assume the essential obligations of marriage by reason of a psychological condition?
Third: To pronounce judgment in favor of cohabitation and compel the husband to continue conjugal life, or to declare definitive separation due to the husband’s responsibility and compel him to pay monthly spousal support? And in what amount?
On 14 April 2004, an urgent decree was issued granting temporary spousal support.
Original Latin: Die 27 novembris 2002 hac sub forma dubia concordata sunt: «Primo: Dichiarare la nullità del matrimonio di Beniamino con Brigida, per errore circa le qualità della moglie congiunto al dolo? Secondo: Dichiarare la nullità di questo matrimonio per l’incapacità della moglie di assumere gli obblighi essenziali del matrimonio per cause di natura psichica? Terzo: Pronunciare la sentenza in favore della convivenza e costringere il marito a proseguire la vita coniugale o dichiarare la separazione definitiva per responsabilità del marito e costringerlo a pagare la pensione alimentare mensile? E di quanto?».
Partes suum vadimonium reddiderunt; decem testes excussi sunt, ex quibus quattuor ab Actore inducti erant; binae peritiae ex officio exaratae sunt. Die 14 aprilis 2004 decretum urgens pensionem alimentariam temporariam latum est.
At the Roman Rota, in 2008, the formula of the doubt was established:
The doubt, by decree of the Ponens dated April 4, 2008, was established in the following form:
1) Whether the nullity of the marriage is established, in this case, due to the woman’s incapacity to assume the essential obligations of marriage, on account of a psychological cause, in accordance with can. 818, n. 3 CCEO;
2) Whether the nullity of the marriage is established due to the man’s error concerning a quality directly and principally intended, conjoined with deceit, in accordance with can. 820 CCEO;
subordinately and insofar as the answer is negative, whether cohabitation is to be restored or rather separation should be declared.
Original Latin: Dubium die 4 aprilis 2008 per decretum Ponentis hac sub forma concordatum est: 1) An constet de matrimonii nullitate, in casu, ob mulieris incapacitatem assumendi onera coniugalia essentialia, ob causam naturae psychicae, ad mentem can. 818, n. 3 CCEO; 2) An constet de viri errore quoad qualitatem directe et principaliter intentam, cum dolo coniunctam, ad mentem can. 820 CCEO; subordinate quidem et quatenus negative, utrum restaurandus sit convictus an potius separatio declarari debeat.
