MATRIMONIAL CASES
1452. Matrimonial cases, if we attend to the force of the name, are those which they consider marriage. But《there are three types of matrimonial cases. Some are about the strength of the initial conjugal bond. … Other cases have been raised either about the validity of the wedding or about law of deciding the divorce of bed and cohabitation. … Others cases finally, are those which consider the connection indeed with marriage, but look back at the purely political matters and directly and immediately temporal matters, just as there are lawsuits which are frequently raised about dowry, gifts on account of marriage, hereditary succession, maintenance and similar things》; Benedict XIV, De Syn. lib. IX, cap. IX, n. 3 et 4. Now already matrimonial cases in a strict sense are pleaded only cases of the first and former type, which are about matrimony, besides the temporal ones of the same effect or duties, just as there are cases about《the nature of matrimony and weddings, the qualities, the contract and nuptial blessings; about the rights and duties of brides and bridegrooms arising from the spousal or matrimonial contract, about the economic value of weddings/betrothals and marriage, and about the legitimacy having arisen of the offspring from that, about the impediments of themselves, likewise, the dispensations in the case of impediments; the dissolution or renewal, etc., of the marriage itself or of the betrothals on account of those (impediments)》Shmalz, lib 4, tit. We plead under this point in time not only about matrimonial cases which consider the value of the marriage itself but all matrimonial cases, supposing nevertheless those which canonists in lib. Decretalium hand over about judgments in kind.

1452. Causae matrimoniales, si vim nominis attendamus, sunt illae quae matrimonium spectant. At 《tria sunt causarum matrimonialium genera. Aliquae versantur circa initi conjugalis foederis firmitatem… Aliae sunt causae excitatae aut super validitate sponsalium, aut super jure instituendi divortium quoad torum et cohabitationem… Aliae demum sunt causae, quae connexionem quidem habent cum matrimonio, sed res mere politicas et temporales directe atque immediate respiciunt, uti sunt lites quae frequenter moventur super dote, donatione propter nuptias, haereditaria successione, alimentis et similibus…》; Benedictus XIV, De Syn., lib.
