Texas Proposal – Overhaul Family Code

Texas lawyer and mediator Michael Hiller is proposing a total overhaul of the Texas family code—that is “Consider a comprehensive review and modernization of the Texas family court system.”  He made his pitch on August 18 to the Texas Commission on Marriage and Family which was established by the state legislators for the purpose of making recommendations to the Texas Legislature to help create a supportive environment for marriage and raising children.

Public comments were welcome. Pro-family Catholic and retired lawyer Beverly Willet made her two-minute comment via video starting at 3:23:47. She asks them to abolish no-fault divorce. Jeff Morgan, a no-fault reform advocate, gave a statement too (3:40:55).

Many of the public comments were from men who want the default in divorce to be 50/50% parenting time. I appreciate why this would be an improvement for dads who lose everyday access to their own children. However, I believe a divorce plaintiff who abandons his spouse when the other has done nothing to justify separation is proof that the plaintiff is not a fit parent. Fit parents work to do what is best for their children and it is best for children to be in a united home with both their mom and dad.

The Texas commission is having monthly meetings through December. They will publish their agenda on September 8 for the Sept. 15 meeting.  Given their previous rules, I figure that members of the public who intend to provide comments by video must pre-register  no later than Sept. 10.
