State Child Support from Catholic Perspective

For Catholics, approaching the civil forum for separation of spouses or divorce is only tolerable in limited circumstances. One consideration required by canon law is whether the State court will issue a decree that is contrary to divine law.

I ask those who think State divorce courts arrange separation plans that are in accord with divine law to learn what really happens to families.  Former child support agent and podcaster, Shah, agreed to talk to me. I asked him to tell viewers what the State will do in various scenarios.

  • stay-at-home mom who is bored with husband files for no-fault divorce (56:56)
  • mom of 5 (age 3-13) who is stay at home mom, with school-age children in private schools, is abandoned my husband who files for no-fault divorce (1:03:07)

Shah says no-fault divorce removes all moral obligations from marriage. What the State does is actually not marriage any more.  I call it state-regulated-pairing.  Shaw cites James Sexton, the big-money divorce lawyer, who says that state marriage is the only contract people enter without reading the terms.

I think getting a state marraige license is entering a pre-nup agreement to abide by the State family Code.

Shah responds to my interest in restoring justice to marriage crises.

(1:32:25) “Justice is really the appropriate topic for that, because  …  Prior to no-fault divorce,  justice, and restoring justice for who was the injured party was was very important. But no-fault is essentially just administrative bureaucratic-style stuff which is unfortunately divorced from any kind of justice or morality. So, a lot of people are starting to wake up to that now. I think a lot of people — especially in the generation before mine — signed up for that, kind of expecting what your describing (a system that is more just). But, then found out they were actually living in one that is amoral.
