EXCERPTS AND NOTE
- “matrimonial cases of the baptized belong by proper right to the ecclesiastical judge” […] “If the church would renounce its own duty and right, it would follow that a separation against the divine law would frequently be imposed or denied” (page 6, from April 19, 1971).
- “because cases of separation surround the reason of the public good and therefore they must be resolved by a public authority” (page 7, from April 19, 1971).
- “Other consultors proposed that it should say ‘servatis cautelis de quibus in § 2,’ [after having observed the precautions mentioned in §2] in place of ‘servato praescripto § 2,’ [ after having observed the prescript of §2] so that the intervention of the Ordinary of the residence of the spouses is not required. It was voted whether this proposition was pleasing: Yes: 3; No: 5” (page 15, from March 31, 1979)
Commentary from Anthony St. Louis Sanchez in Canon Law Thesis
“Some members of the coetus in 1979 had suggested that if the case concerned merely the civil effects, then the judge himself could allow the parties to approach the civil forum [footnote]. However, this suggestion was not accepted by the coetus. Thus, even if a person wants the mere civil effects of a divorce, permission of the diocesan bishop is still required.”
