No-Fault Divorce Destroyed the Legal System

For the first time in centuries, innocent people are summoned to court – with no accusation of fault – and punished.

Steven Baskerville, political science professor, explains the two biggest disasters caused by no-fault divorce. The first disaster was the destruction of the institution of the family. The less-publicized second disaster is that no-fault destroyed the legal system. Innocent people are punished by being kicked out of their home, having their bank accounts seized and raided, and having your children taken away.

The no-fault system institutionalized injustice.

In my work as a Catholic upholding marriage, I ask the leaders of Catholic and Christian Church’s to recognize this abomination against natural law and justice

The Thomistic Institute publicizes St. Thomas Aquinas’ teaching on justice:

“Justice establishes right relation with others and is the perpetual and constant will to render each one his due.” […]  “Whatever its type, every sin against justice requires that restitution be made to the one injured, with compensation also required where strict restitution cannot be paid or fails to restore what has been unjustly taken.” […] “In cases against communitive justice, the political authority justly steps in to punish the malefactor. It does so in the name of the common good to satisfy the injuries suffered by the political community when one of its members unjustly injures another member”

No-fault divorce is unjust because the political courts require the Defendant to make restitution even though the Defendant was never accused, or proven, to have committed any injury against the Plaintiff, nor found to be a malefactor.  According to the principles of Catholic marriage, one is only justified in separating from the other when the other has committed some grave fault (adultery, abuse, abandonment). But, with no fault divorce, abandoners use the government’s no-fault system to punish the faithful spouse who’s committed none of these offenses.
